Houston Annual Surcharges
DWI Lawyer in Houston
Driving while under the influence of impairing substances can be a difficult charge to face. There are many different kinds of evidence that will be compiled against you, and there can be very harsh consequences if convicted. Conviction for DWI can include fines, jail time and license suspension. Each of these can be very difficult to deal with, especially in the case of needing to get to work and provide for a family.
There is another consequence that can be incurred if someone is convicted of DWI. These are called annual surcharges, and they are fines that the individual will have to pay on an annual basis. There are two ways to incur an annual surcharge: the first is through a point system, and the second is conviction-based. The point system requires six points in order to incur a $100 annual fine for three years, and $25 will be added to this for each additional point incurred.
Points can be accumulated for a Texas or out-of-state moving violation conviction which earns two points; a Texas or out-of-state moving violation which results in a crash will result in the accumulation of three points. The conviction-based surcharge will decide the fine; the duration of the fine is set for three years. For example, a first DWI conviction in Texas or out-of-state will result in a $1,000 fine for three years.
