Felony DWI Attorney in Houston

What makes DWI a felony?

While most first time DWI charges and even a 2 nd offense are treated as misdemeanors, certain circumstances can result in a felony DWI charge. You can be charged with a felony if it is your 3 rd or more DWI offense. If you are arrested for DWI and there was a child passenger under the age of 15 years old, this will result in a felony DWI. You will be charged for a felony if you are being prosecuted for intoxicated assault or intoxicated manslaughter. Any of these crimes are severely punished if you are convicted, and a Houston DWI lawyer with experience and an outstanding knowledge of Texas DWI laws will be required for an effective defense.

Properly defending felony DWI charges can be complex and requires thorough investigation into the exact circumstances of the case and what actually occurred. Sometimes, law enforcement conducts an improper search and seizure, making the evidence against you inadmissible. Illegal interrogation, denial of the right to counsel and other important points of the law can, at times, be used in your defense. Other times, flawed scientific evidence may be used by the prosecution to try to prove you guilty. It is vital that I, Attorney Ned Barnett, am able to get to work on your case quickly so that a successful defense can be mounted on your behalf.

What penalties will I face?

If you are convicted of a 3rd DWI offense, your driver's license can be suspended for up to 2 years, you can be fined up to $10,000 and you may be imprisoned for up to 10 years. DWI with a child under 15 year old can be punished by a fine up to $10,000 and you can be incarcerated for up to 2 years. Intoxication manslaughter carries with it a sentence of between 2 and 20 years in prison.

Your life as you currently live it and the lives of your loved ones are both important to you. I realize that you may be in a situation that you never thought you would be in. Since 1994, I have been successfully defending those accused of DWI crimes. As a former state and federal prosecutor, I know how felony DWI charges are prosecuted and have proven success in getting them resolved in the best manner possible.
