First Time Offense Penalties

If you are convicted, you may have to go jail for a period of 72 to hours to 180 days. This penalty can be increased to 2 years in jail if there was a child passenger in your vehicle under the age of 15. Commonly, the fine will be up to $2,000 unless there was a minor passenger involved, in which case the fine can go up to $10,000. In addition, you may have to pay a DWI surcharge of $1,000-$1,500 per year and your drivers license may be suspended.
