According to the Texas Penal Codes, intoxication assault (also known as DWI with serious bodily injury), is a third degree felony. The elements of the charges are:

  • That an individual operated a motor vehicle in a public place
  • The person was intoxicated
  • Due to the intoxication, the individual caused a serious bodily injury to another

The term "serious bodily injury" refers to an injury that creates a substantial risk of death or that causes serious permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.
