![]() Site MapHouston, Texas DWI defense lawyer Ned Barnett has dedicated his career to being a strong, capable and effective criminal defense attorney like his father, grandfathers and great grandfather before him. Attorney Barnett is Board Certified in Criminal Law and is a founding member of the National College for DUI Defense. All Felony and Misdemeanor charges in Federal and State court. Many Texas drivers who are arrested for driving while intoxicated do not realize that a DWI arrest creates two cases. More specifically, a DWI arrest results in a criminal charge, but it also initiates a civil proceeding against the arrested motorist's driving privileges called an administrative license revocation, or ALR. In Texas that means .08% of Blood Alcohol Content or any amount which results in loss of normal use of mental or physical faculties. This is only a guide and NOT sufficiently accurate to be considered legal evidence. The figures you calculate are averages. Individuals may vary somewhat in their personal alcohol tolerance. Food in the stomach affects the rate of absorption. Medications, health, and psychological condition are also influential factors. In any case, if you've been drinking at all, be careful! Probation: Most people convicted of a first offense DWI do not serve any jail time. They are technically sentenced to jail, but the jail sentence is suspended and they are put on probation (community supervision). The probation is generally for a term of one to two years. While on probation you must do what the judge orders you to do. These orders are called conditions of probation. If you do not do what the judge has ordered you to do (the conditions) then the judge has the option of revoking your probation and putting you in jail for any number of days up to the original jail sentence you received that was suspended. If you are under the age of 21 the DWI laws are more severe. You can be below the legal limit for an adult (a person 21 or over) and be charged with a DUI (driving under the influence). This is a zero tolerance law just for people under the age of 21. This law states that if a minor has "any detectable amount of alcohol in his/her system" while driving a motor vehicle then they have committed DUI. Why Hire A Good DWI Attorney I am of the belief that a person accused of a crime should hire the best attorney that he/she can find and afford. If a citizen accused walks into court with an incompetent attorney or one without the proper background and training it can haunt them for the rest of their life. The prosecutors on the other side are skilled attorneys. Once a case gets to court I believe their primary goal is to obtain a conviction. The better the defense attorney the tougher it will be for the government to be successful in convicting you of the charges.s Texas Department of Transportation Texas Department of Public Safety Mothers Against Drunk Driving You may reach us 24 hours a day, 7 days a week by calling our office at (713) 222-6767 or toll-free at (800) 338-8070.
